Borno Youth Leader Arraigned Over Alleged Terror Financing After Acting as Kidnap Negotiator

The Department of State Services (DSS) has arraigned Samaila Ibrahim Kaigama, President of the Borno State Youths Association, before the Federal High Court in Abuja over allegations of financing Boko Haram and the Islamic State West Africa Province (ISWAP).

Kaigama was brought before Justice Salim Ibrahim on a four count charge accusing him of concealing information on terrorist activities and allegedly raising and receiving funds from members of the public under the guise of negotiating the release of kidnapped victims.

Prosecutors alleged that the funds were knowingly channelled to the terrorist groups, an offence that falls under Nigeria's terrorism laws.

The youth leader pleaded not guilty to all the charges.

The court ordered that he be remanded in DSS custody pending trial but directed that he be granted access to his lawyer, wife and uncle, while also receiving adequate medical care.

The case was adjourned until September for the commencement of trial.

Kaigama's arrest followed a television interview in which he openly discussed his role in negotiating with Boko Haram and ISWAP for the release of abducted victims in parts of Borno State.

The case has drawn national attention because it raises a critical legal question: At what point does negotiating with terrorists to free victims become an act of supporting terrorism?

Under Nigeria's anti terrorism laws, knowingly providing funds, financial services or any form of material support to a proscribed terrorist organisation, regardless of the intention, may amount to terrorism financing.

Kaigama has denied all allegations, insisting he acted only to secure the freedom of kidnapped victims.
